Divorce abroad

If the divorce took place abroad, formal recognition is necessary for it to be effective in Germany, because divorces are generally only legally effective in the state in which they were issued.

Formal recognition can be waived if it concerns:

• a so-called home state divorce (both spouses have the same nationality and the divorce was announced in the home state)
  or
• a decision from a member state of the European Union.
